These Terms of Service govern your use of SMS messaging services powered by Highmark, an AI SMS concierge platform operated by Whiteout Solutions ("we," "our," or "us").
Highmark enables businesses to communicate with their customers via SMS. By engaging with a Highmark-powered business via text message, you agree to these terms.
Highmark provides messaging infrastructure that businesses use to respond to customer inquiries, assist with bookings, and send service-related updates. Messages you receive are sent on behalf of the specific business you engaged with — not by Highmark directly.
The business you contacted is responsible for obtaining your consent before any messages are sent. Highmark processes and delivers those messages as a service provider.
You may opt in to receive SMS messages from a Highmark-powered business in two ways:
Consent is not a condition of purchase. You are not required to opt in to receive SMS messages in order to make a purchase, complete a booking, or access any business's services. Messaging is entirely optional.
Opt-in consent is specific to each business. Consenting to receive messages from one Highmark-powered business does not apply to any other business on the platform.
Depending on your interaction, you may receive messages related to:
Message frequency varies based on your level of interaction with the business. Message and data rates may apply depending on your carrier and plan. Contact your carrier for details.
You can stop receiving messages at any time. Standard SMS keywords are always supported:
Opt-outs are processed before any other message handling and take effect immediately.
You agree not to use Highmark-powered messaging services to:
We reserve the right to block or restrict access to the service for any number that violates these terms.
Highmark provides this service on a best-effort basis. We do not guarantee that the service will be available at all times or that messages will be delivered without delay. SMS delivery is subject to carrier conditions outside our control.
We may modify, suspend, or discontinue any aspect of the service at any time with reasonable notice where practicable.
To the extent permitted by applicable law, Whiteout Solutions and Highmark are not liable for any indirect, incidental, or consequential damages arising from your use of SMS messaging services, including missed messages, delivery delays, or service interruptions.
Our total liability for any claim related to this service shall not exceed the amount paid, if any, for the specific service giving rise to the claim.
Your use of Highmark-powered messaging is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. For details on how we handle SMS opt-in and consent data, see our SMS Consent page.
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
